Move Over. Slow Down.

It’s not just a good idea, as of April 27, 2021, it’s the law in Pennsylvania. 

Known as Pennsylvania’s Move Over Law, drivers approaching an emergency response area who are unable to safely merge into a lane away from the area are required to pass at a speed of no more than 20 miles an hour less than the posted speed limit. This means a driver approaching an emergency response area on a roadway with a posted speed limit of 55, must safely pass at no more than 35 miles an hour.

Emergency response areas are defined as any area where an emergency vehicle has its lights flashing, or where road crews or responders have placed flares or posted caution signs as a warning to travelers.

This important law is designed to provide a higher level of safety for responders, victims and motorists. For those failing to move to a lane further away or passing at speeds in excess of the legal limit, the state will impose legal actions, including points for failure to merge, tiered fines for first, second and third offenders, license suspensions, and additional fines for violators who injure or kill any person in or near a disabled vehicle. 

A similar regulation also requires motorists to move over or slow down when approaching stationary trash or recycling trucks.
